Updated: Troopers investigating fatal motor vehicle crash north of Milford

(UPDATED) MILFORD, Del. – The Delaware State Police Collision Reconstruction Unit is currently investigating a fatal motor vehicle crash that occurred north of Milford Thursday evening.

Preliminary investigation indicates the crash occurred around 5:20 p.m. Thursday, Jan. 14 as Julio C. Garcia, 37 of Milford, was operating a 2002 GMC Safari van southbound on Bay Rd (US113/SR1) just north of Cicada Lane.

For unknown reasons, the van drifted into the center media where is struck a road sign, and as Garcia attempted to enter back onto the roadway, he over-corrected and drove off the west side of the road where the van struck a tree.

Garcia, who was properly restrained, was removed from the scene by EMS and transported to Bayhealth Milford Memorial Hospital (MMH) where he was treated and released with non-life-threatening injuries.

Ruben Martinez, 31 of Milford, was a front seat passenger in the van and was not properly restrained. He was pronounced dead at the scene.

A rear seat adult male passenger in the van, 29-year-old Virginio Lopez of Milford, was transported initially by EMS to MMH before being airlifted to Christiana Medical Center where he remains in critical condition.

The State Police Collision Reconstruction Unit is continuing their investigation into this incident and alcohol does not appear to be a factor in this case. No charges have been filed at this time. SR1 southbound between Old Cemetery and Cicada Lane was closed for approximately three hours while the crash was investigated and cleared.

Preliminary investigation indicates the crash involved a single vehicle and one person has died at the scene.  The State Police Collision Reconstruction Unit is currently on scene and will assume the investigation.
 
SR1 southbound traffic is currently being diverted onto Old Cemetery Road north of the crash.   Commuters are advised to seek alternate routes of travel.
 
Further details will be released upon the conclusion of the investigation.
